Pass the Love Card Terms

1. About These Terms

These Terms are between you (“you”) and Tammy Dennis, an individual doing business as [Cold Streets Clothing Company] (“Cold Streets,” “we,” “us,” or “our”).

They cover free and paid Pass the Love Cards. They include our Terms of Service, Privacy Policy, Community Guidelines, Youth Safety Policy, and Giving and Transparency Policy .

You accept these Terms by checking the agreement box or submitting a Card.

2. What a Pass the Love Card Is

A Pass the Love Card is a customizable Card you create on the Site to share kindness and support people helping people and causes.

You choose a Card design, enter your information, and sign or decorate the Card.

Cards are displayed on the Wall for a state, a country, or the Worldwide Area, and can be shared from the Site.

3. Free Cards

Free Cards cost nothing to share. You may ask us to display your free Card on the Wall for a state or country in support of Pass the Love Fundraisers.

A person under 18 may share a free Card only with a parent or guardian’s permission.

We review every request, may decline or remove any Card, and display free Cards [for as long as we decide].

Free Cards do not involve a sale and do not generate giving amounts.

4. Paid Cards

Who May Buy

You must be at least 18 years old to buy a paid Card.

Price

$98.88 per Card, plus any applicable taxes.

What You Get

Your paid Card is displayed for one year on the Site and is linked in support of Pass the Love Fundraisers.

It is displayed on the Wall of the state or country you enter when you order, or in the Worldwide Area if your state or country is not available yet.

When It Goes Live

Please allow 24 hours after approval for your Card to appear on the Wall.

Your year starts on the day your Card goes live. It does not renew automatically, and we will not charge you again unless you buy another Card.

Your Cause

At checkout, you choose a cause through the ShoppingGives app. If you do not change the cause shown, the amount goes to the cause shown.

The standard 8/8/8 split in our Giving and Transparency Policy applies to paid Cards.

5. Creating Your Card

Choose a Card, enter your information, sign or decorate your Card, and add it to your cart.

All Cards must be suitable for everyone: kind, positive, and rated Everyone, as described in our Community Guidelines.

Please do not include QR codes, web addresses, phone numbers, email addresses, social media handles, or other contact details on your Card.

[Cards are not Advertising. Businesses that want to advertise may use Biz Card Bonanza or Biz Ads Worldwide.]

Please enter your state or country carefully because it determines where your Card is displayed.

6. Your Information and Emails

Why We Ask

We collect your contact name, email address, and state or country to review your Card, help prevent abuse and misuse of the Service, place your Card on the correct Wall, and contact you about your Card.

[They are not displayed on the Wall.]

If you are under 18, please use a parent or guardian’s email address. We use your information as described in our Privacy Policy.

Emails About Your Card

We will email you about your Card, such as approval, problems, or refunds. These messages are part of the Service.

Marketing Emails

We send marketing emails only to people who are at least 18 years old and have chosen to receive them, where required by law, by checking the optional box.

You can unsubscribe at any time using the link in any email, and we will still send you messages about your Card.

7. Your Card Content

You keep ownership of your Card Content. The license in Section 12 of our Terms of Service applies.

You promise that you own or have permission to use everything in your Card, that it follows our Community Guidelines, and that anyone named or shown has agreed.

For a person under 18, use a first name or initial only, get written permission from a parent or guardian, and never include a child’s last name, school, location, contact details, or social media handle.

8. Review and Approval

We review every Card before it appears on the Wall.

We may decline, edit, hide, or remove a Card that does not follow these Terms or our Community Guidelines.

If we decline a paid Card before it goes live, you may fix it within [14 days] or receive a full refund.

9. Refunds

You may cancel a paid Card for a full refund within [7 days] of purchase if it has not gone live.

After a paid Card goes live, all sales are final, except that if we end the Program or cannot display your Card, we will refund the unused part of your year.

If we remove a Card because you broke these Terms, you are not entitled to a refund.

Refunds go to your original payment method.

10. Not a Donation

A paid Card is a purchase from Cold Streets. It is not a charitable donation to Cold Streets or to any cause, and we do not provide tax advice or promise that any payment is tax-deductible.

Causes and fundraiser Groups are independent, and their appearance does not mean we endorse them.

11. No Guarantees

We do not promise any amount of money raised, views, visitors, or results. The Wall is provided “as is” and “as available.”

Any giveaway is covered by its own Official Giveaway Rules. Buying a Card does not enter you in a giveaway unless those rules say so.

To the fullest extent permitted by law, our liability is limited as stated in our Terms of Service, and our total liability for a paid Card will not exceed the amount you paid for it.

12. Changes and Other Terms

We may update these Terms by posting a new “Last Updated” date. The Terms in effect when you buy govern your paid Card.

These Terms, together with the documents they reference, are the entire agreement about Pass the Love Cards.

California law governs, as described in Section 22 of our Terms of Service.

If any part is unenforceable, the rest stays in effect.
