Who We Are
This Website, ColdStreets.com (the “Site”), is operated by Tammy Dennis, an individual doing business as Cold Streets Clothing Company (“Cold Streets,” “we,” “us,” or “our”). Throughout the Site, “you” means anyone who visits, buys from, advertises on, sponsors, or otherwise uses the Site or any of our programs (together, the “Service”).
By using the Service, you agree to be bound by these Terms of Service (“Terms”), including the policies and program terms linked in these Terms. If you do not agree to all of these Terms, you may not use the Service. These Terms apply to all users, including browsers, customers, advertisers, sponsors, affiliates, fundraisers, and contributors of content.
Please read these Terms carefully. We may update them as described in Section 24. Our store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell to you. Our merchandise is made on demand and shipped by Printful, Inc., an independent fulfillment partner.
Section 1 - Who May Use the Service
You must be at least 18 years old, or the age of majority where you live, to make a purchase, place an advertisement, become a sponsor, join the affiliate program, or sign any agreement with us. Minors may use the Site only with the permission of a parent or legal guardian, and may take part in fundraising only through an approved adult representative as described in the Fundraiser Agreement. We do not knowingly collect personal information from children under 13.
You may not use the Service for any illegal or unauthorized purpose, or violate any laws in your jurisdiction, including copyright laws. You must not transmit any worms, viruses, or code of a destructive nature. A breach of these Terms may result in immediate termination of your access.
Section 2 - Our Youth-Friendly Community Standard
Cold Streets is a youth-friendly community platform. Everything posted or displayed through the Service, including Pass the Love Cards, advertisements, sponsorships, and fundraisers, must be suitable for a community that includes young people. We may refuse, remove, or edit any content, application, or participant that does not meet this standard, as described in our Community Guidelines and Community-Friendly Advertising Standards.
Section 3 - General Conditions
We reserve the right to refuse service to anyone for any lawful reason at any time. You understand that your content, not including credit card information, may be transferred unencrypted and involve transmissions over various networks and changes to conform to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service without our express written permission.
Section 4 - Accuracy, Completeness, and Timeliness of Information
We are not responsible if information on this Site is not accurate, complete, or current. The material on this Site is provided for general information only and should not be relied on as the sole basis for making decisions. Any reliance on the material on this Site is at your own risk.
We may modify the contents of this Site at any time, but we have no obligation to update any information. You agree that it is your responsibility to monitor changes to our Site.
Section 5 - Modifications to the Service and Prices
Prices for our products and services are subject to change. Changes do not affect orders already placed. We may modify or discontinue the Service, or any part of it, at any time. We are not liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service.
Section 6 - Products
Our products are made on demand by Printful and may be available online only. Shipping is governed by our Shipping Policy, and returns, exchanges, and refunds are governed by our Returns, Exchanges, and Refunds Policy.
We display product colors and images as accurately as possible, but we cannot guarantee that your screen will show any color accurately. We may limit the sale of our products to any person, region, or jurisdiction, and may limit quantities or discontinue any product at any time.
Product descriptions and prices are subject to change. Any offer is void where prohibited. We do not warrant that the quality of any product, service, or information you obtain will meet your expectations, or that any errors will be corrected.
Section 7 - Accuracy of Billing and Account Information
We reserve the right to refuse or cancel any order. We may limit or cancel quantities purchased per person, per household, or per order, including orders placed under the same account, payment method, or billing or shipping address.
If we change or cancel an order, we may try to notify you using the email, billing address, or phone number provided at the time of order. We may limit or prohibit orders that appear to be placed by dealers, resellers, or distributors.
You agree to provide current, complete, and accurate purchase and account information for all purchases, and to promptly update your information so we can complete your transactions and contact you when needed. For more details, please review our Returns, Exchanges, and Refunds Policy.
Section 8 - Program Terms
Some parts of the Service have their own terms, which apply in addition to these Terms:

If there is a conflict, the program terms control for that program, and these Terms control everything else.
Section 9 - Giving, Charity, and Tax Matters
Cold Streets is a for-profit business and is not a charity. Under our 8/8/8 Program, a portion of each sale is directed to the referring affiliate, to a cause chosen by the buyer, and to hunger relief, as explained in our Giving and Transparency Policy.
Purchases, advertising, sponsorships, and Pass the Love Card purchases are payments to Cold Streets for goods or services. They are not charitable donations to Cold Streets, and we do not provide tax advice or promise that any payment is tax-deductible.
Causes and organizations named on the Site are independent, and their appearance does not mean they endorse us or any advertiser, sponsor, or product.
Section 10 - Advertisers, Sponsors, and Third Parties
Advertisers and sponsors are independent businesses. We review applications under our Community-Friendly Advertising Standards, but we do not endorse, guarantee, or take responsibility for any advertiser, sponsor, or their products, services, or claims.
Any dealings you have with an advertiser or sponsor are solely between you and them. Please direct complaints about an advertiser or sponsor to them, and you may also report concerns to us at support@coldstreets.com.
Section 11 - Optional Tools and Third-Party Links
We may provide access to third-party tools over which we have no control. Those tools are provided “as is” and “as available,” without warranties or endorsement, and your use of them is at your own risk.
Links on this Site may lead to third-party websites that are not affiliated with us. We are not responsible for the content, accuracy, policies, or practices of any third party, or for any harm or damages related to transactions made with a third party.
Please review third-party policies carefully before you engage in any transaction. Direct complaints about third-party products to the third party.
Section 12 - Content, Cards, Comments, and Submissions
You keep ownership of what you submit. By submitting a Pass the Love Card, comment, image, advertisement, or other material (“Content”), you give us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, edit, and distribute it on the Site, in connection with the Service, and in our promotion.
You promise that you own or have permission to use the Content, that it does not violate anyone’s rights, and that any person named or shown in it has agreed, with a parent or guardian’s permission for anyone under 18.
We have no obligation to keep Content confidential, pay for it, or respond to it. We may, but are not required to, monitor, edit, or remove Content that we decide is unlawful, offensive, threatening, defamatory, obscene, unsuitable for young people, or in violation of these Terms.
You may not use a false email address or pretend to be someone else. You are solely responsible for your Content, and we take no responsibility for Content posted by you or any third party.
Section 13 - Copyright Complaints
If you believe Content on the Site infringes your copyright, send a notice to our designated agent at support@coldstreets.com that includes:
- Your contact information;
- A description of the work and where the material appears;
- A statement that you believe in good faith that the use is not authorized;
- A statement, under penalty of perjury, that your notice is accurate and you are authorized to act; and
- Your signature.
We may remove Content and terminate repeat infringers.
Section 14 - Personal Information
Your submission of personal information through the Service is governed by our Privacy Policy. Please review our Privacy Policy.
Section 15 - Errors, Inaccuracies, and Omissions
Occasionally, information on our Site or in the Service may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times, and availability.
We may correct any errors, inaccuracies, or omissions, and change or update information or cancel orders if information is inaccurate, at any time, including after you submit an order. We have no obligation to update, amend, or clarify information, except as required by law.
Section 16 - Prohibited Uses
In addition to other prohibitions in these Terms, you may not use the Site or its Content:
- For any unlawful purpose;
- To solicit others to perform unlawful acts;
- To violate any international, federal, state, or local law, rule, or regulation;
- To infringe our intellectual property rights or the intellectual property rights of others;
- To harass, abuse, insult, harm, defame, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
- To submit false or misleading information;
- To upload or transmit viruses or other malicious code;
- To collect or track the personal information of others;
- To spam, phish, pharm, pretext, spider, crawl, or scrape;
- For any obscene or immoral purpose;
- To interfere with or circumvent the security features of the Service or any other website or the Internet;
- To contact or collect personal information from minors in an unsafe or unlawful way; or
- To post or promote content that is sexual, violent, hateful, or otherwise unsuitable for a youth-friendly community.
We may terminate your use of the Service for violating any prohibited use.
Section 17 - Disclaimer of Warranties; Limitation of Liability
We do not guarantee that your use of the Service will be uninterrupted, timely, secure, or error-free, or that results from the Service will be accurate or reliable. We may remove the Service for indefinite periods or cancel it at any time.
Your use of, or inability to use, the Service is at your sole risk. The Service and all products and services delivered through it are provided “as is” and “as available,” without warranties or conditions of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.
To the fullest extent permitted by law, Cold Streets, Tammy Dennis, and our contractors, agents, suppliers (including Printful), service providers, and licensors will not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including lost profits, lost revenue, lost savings, loss of data, or replacement costs, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of the Service or any product or Content, even if advised of the possibility.
Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud or willful misconduct, or any consumer rights you have under the laws of your place of residence. Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability will be limited to the maximum extent permitted by law.
Section 18 - Indemnification
You agree to indemnify, defend, and hold harmless Cold Streets, Tammy Dennis, and our affiliates, partners, agents, contractors, licensors, service providers, suppliers, and employees from any claim or demand, including reasonable attorneys’ fees, made by a third party because of your breach of these Terms or the documents they incorporate by reference, your Content, or your violation of any law or the rights of a third party.
Section 19 - Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, it will be enforced to the fullest extent permitted by law, and the unenforceable portion will be severed without affecting the validity of the remaining provisions.
Section 20 - Termination
Obligations and liabilities incurred before termination survive termination. These Terms remain effective until ended by you or us.
You may end them at any time by notifying us that you no longer wish to use the Service or by ceasing to use the Site. If you fail, or we suspect you have failed, to comply with these Terms, we may end this agreement at any time without notice, and you remain liable for all amounts due up to the date of termination.
We may also deny you access to the Service or any part of it.
Section 21 - Entire Agreement
Our failure to exercise or enforce any right or provision of these Terms is not a waiver of that right or provision.
These Terms, together with the policies and program terms they reference, are the entire agreement between you and us and replace any earlier agreements, communications, or proposals, whether oral or written. Any ambiguity will not be interpreted against the drafting party.
Section 22 - Governing Law
These Terms and any separate agreements between you and us are governed by the laws of the State of California, without regard to conflict-of-law rules.
Where allowed by law, disputes will be brought in the state or federal courts located in California. Nothing in this Section limits any consumer rights you have under the laws of your place of residence.
Section 23 - Notice to California Residents
Under California Civil Code Section 1789.3, California users are entitled to the following notice. The Service is provided by Tammy Dennis, doing business as Cold Streets Clothing Company, [Mailing Address], [Phone Number].
Charges for the Service are shown at checkout or in the applicable program terms. If you have a question or complaint about the Service, contact us at support@coldstreets.com.

Section 24 - Changes to These Terms
We may update, change, or replace any part of these Terms by posting the changes on this page with a new “Last Updated” date.
Changes apply to your use of the Service after the date they are posted, and orders already placed are governed by the Terms in effect when you placed them. It is your responsibility to check this page periodically. Your continued use of the Service after changes are posted means you accept them.
