Who We Are and What This Policy Covers

This Privacy Policy explains how Tammy Dennis, an individual doing business as [Cold Streets Clothing Company] (“Cold Streets,” “we,” “us,” or “our”), collects, uses, and shares personal information when you visit ColdStreets.com (the “Site”), buy from us, or take part in our Programs.

Our Programs include Pass the Love Cards, Pass the Love Fundraisers, Biz Card Bonanza, Biz Ads Worldwide, Cold Streets Sponsorships, giveaways, the Affiliate Program, and the 8/8/8 Program (together, the “Service”).

By using the Service, you agree to this Policy.

Information You Give Us

  • Orders: Your name, billing and shipping address, email address, phone number, and order details. Payments are processed by Shopify Payments, PayPal, or other payment providers. We do not receive or store your full card number.
  • Applications and forms: When you apply as an advertiser, sponsor, fundraiser, or Affiliate, or fill out any form, we collect what you submit, such as your business or organization name, contact details, website, reference number, logos, images, and answers.
  • Pass the Love Cards and other Content: The contact name, email address, and state or country you enter when you create a Card, along with the Content of your Card, such as names, messages, images, and signatures. [Your contact name and email address are not displayed on the Wall.] Content you ask us to display becomes public. Cards may include the names of people other than the person who submitted them.
  • Affiliate payments and tax information: Your PayPal payout email and commission details. Tax forms, such as Form W-9 or Form W-8BEN, are collected only through the secure link from Tax1099.com . Please never send tax IDs or tax forms to us by email, text, or social media.
  • Emails, giveaways, and messages: Your email address if you subscribe, enter a giveaway, contact us, or choose to receive updates when you create a Card, along with the content of your messages.

Information We Collect Automatically

When you visit the Site, we automatically collect device and usage information, such as your IP address, browser, time zone, cookies installed on your device, the pages or products you view, websites or search terms that referred you, and how you interact with the Site.

We collect this information using cookies, log files, web beacons, tags, and pixels. If you arrive through an Affiliate link, a cookie lasting 88 days records the referral so the Affiliate can be credited.

Information from Others

We receive information from Shopify, Printful, payment providers, our Affiliate platform, and fraud-prevention tools. This information helps us process orders and protect the Service.

How We Use Information

We use personal information to:

  • Process orders, payments, and shipping;
  • Communicate with you, including about your Pass the Love Card;
  • Run our Programs, including displaying Cards, placing advertisements, managing fundraisers, paying Affiliate commissions, and carrying out our 8/8/8 giving;
  • Review Cards, Content, and applications to keep the Site youth-friendly and community-friendly;
  • Help prevent abuse and misuse of the Service, such as spam, harmful Content, and fraud;
  • Send marketing emails to people who have opted in, or where the law allows, always with an unsubscribe link;
  • Screen orders and Cards for fraud and risk;
  • Understand and improve the Site; and
  • Comply with the law.

How We Share Information

We share personal information with service providers who help us run the Service, only as needed to provide their services. These providers may include:

  • Shopify: Store, checkout, and hosting services, including Shop features.
  • Printful: Making and shipping orders.
  • GemPages: Page-building services.
  • BixGrow: Affiliate tracking and management.
  • ShoppingGives: Cause selection and charity donations.
  • Formspree: Form submissions.
  • Tax1099.com: Tax forms and reporting.
  • PayPal: Payments and Affiliate payouts.
  • Live Product Options: Checkout fields.
  • [Google Analytics: Site analytics.]
  • [Your email marketing tool.]
  • [Advertising or social platforms you use.]

We also share information:

  • Publicly: When you ask us to display a Card, advertisement, sponsor listing, or fundraiser;
  • To comply with laws, subpoenas, search warrants, or other lawful requests, or to protect our rights;
  • If the business is sold or transferred; and
  • With your consent.

We do not sell personal information for money. [If you use advertising pixels: Some of the tools above may count as “sharing” personal information for cross-context behavioral advertising under California law. You can opt out as described below.]

Cookies and Tracking Choices

You can control cookies through our cookie banner, where offered, and through your browser settings. To learn more about cookies and how to disable them, visit www.allaboutcookies.org .

Blocking cookies may affect how the Site works. Where required by law, we treat browser opt-out signals such as Global Privacy Control as a request to opt out of sale or sharing.

We do not currently respond to “Do Not Track” signals because there is no common standard for them.

We may use your information to show you advertisements or marketing communications you may find interesting.

You can opt out of targeted advertising at optout.aboutads.info and www.networkadvertising.org/choices , and in the ad settings of platforms you use, such as Facebook and Google.

Marketing Emails

We send marketing emails only to people who have opted in, or where the law allows.

When you create a Pass the Love Card, receiving marketing emails is optional, is available only to people 18 and older, and is never required to use the Service.

You can unsubscribe at any time using the link in any email. If you unsubscribe, we may still send messages about your order or Card.

Children’s Privacy

The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13.

Purchases and agreements require you to be at least 18. People under 18 may share a free Pass the Love Card only with a parent or guardian’s permission and should use a parent or guardian’s email address.

We do not add anyone we know is under 18 to our marketing email list.

Youth fundraising is handled only through approved Adult Representatives, who should submit a child’s information only with parent or guardian consent and only when necessary.

We do not sell or share the personal information of anyone we know is under 18, and we do not use it for targeted advertising.

If you believe a child has given us personal information, email support@coldstreets.com and we will delete it.

Security

We use reasonable measures to protect personal information, including secure providers for payments and tax forms. No method of transmission or storage is 100% secure, so we cannot guarantee absolute security.

Data Retention

We keep order and tax records for [7 years], or as long as the law requires.

We keep applications, fundraiser records, and Affiliate records for as long as the relationship lasts plus [X years].

We keep Pass the Love Card Content and contact information while a Card is displayed, and for [X years] afterward to help prevent abuse and keep records.

We keep marketing information until you unsubscribe. We delete or de-identify information when we no longer need it.

International Transfers

We and our service providers are based mainly in the United States, and your information may be processed in the United States and other countries, which may have different privacy laws than where you live.

Your Privacy Rights

You can ask us to tell you what personal information we hold about you, to correct it, or to delete it. You can also unsubscribe from marketing emails at any time using the link in any email.

California Residents

Under California law, you may have the right to:

  • Know what personal information we collect, use, and disclose;
  • Request deletion or correction;
  • Opt out of the sale or sharing of your personal information;
  • Limit the use of sensitive personal information; and
  • Be free from discrimination for using your rights.

California residents may also request information about disclosures of personal information to third parties for their direct marketing purposes.

European Economic Area and United Kingdom Residents

You may have the right to access, correct, delete, restrict, or object to the use of your personal information, to data portability, and to withdraw consent.

We process your information to fulfill our contract with you, for our legitimate business interests, including preventing abuse, to comply with legal obligations, and with your consent where required, including for marketing emails.

You may also complain to your local data protection authority.

Other Locations

Residents of other U.S. states or countries may have similar rights under local law. Contact us and we will honor them as required.

How We Handle Requests

We may need to verify your identity before acting on a request. We respond within the time required by law, generally within 45 days.

You may use an authorized agent to make a request for you. If we decline a request, you may appeal by emailing support@coldstreets.com with “Appeal” in the subject line.

Third-Party Links

The Site may link to websites we do not control, including advertiser, sponsor, and cause websites. We are not responsible for their privacy practices.

Changes to This Policy

We may update this Policy from time to time. When we do, we will post the new version with a new “Last Updated” date, and we will provide additional notice of material changes where required by law.
